Term of Use

Article 1 (Membership)

1. A “member” is an individual who completes a membership application upon consenting to the terms of use, following the procedures established by the company.
2. “Member information” includes information a member discloses to the company regarding him or herself, member transaction history, and other information.
3. The terms of use apply to all members, and are to be observed during and after registration.

Article 2 (Registration)

1. Qualification for Membership
Customers qualify for membership upon consenting to the terms of use and completing the established membership application and registration procedures. Please be sure that membership registration is performed by the actual individual seeking membership; registration by proxy will not be accepted. Membership applications may be declined for individuals who have had their membership qualifications revoked in the past, or for individuals deemed otherwise unsuitable by the company.

2. Entering Member Information
When registering for membership, please read the data entry warnings carefully, and fill out the required items of the prescribed form accurately. Special symbols, Chinese characters no longer in use, roman numerals, and other characters may not be used when registering member information. If such characters are registered, they will be changed by the company.

3. Password Management
(1) Passwords may be used only by the member him or herself and may not be transferred or leased to a third party.
(2) The company asks that members be responsible for the management of their own passwords. This includes changing passwords regularly to prevent discovery by others.
(3) Actions toward the company—performed using a password—that indicate the intention to bring about a legal effect will be considered indicative of the intention of the member him or herself, and the resulting payment and other obligations will be the full responsibility of the member.

Article 3 (Changes to Information)

1. The member will contact the company promptly should there be changes to the information he or she has reported to the company, such as name, address, and the like.
2. The company assumes no responsibility for damages incurred by failure to register these changes. Please note that even if changes are registered, transactions whose procedures were completed prior to registration of the changes will be carried out based on pre-registration information.

Article 4 (Membership Cancellation)

Please be sure that membership cancellation procedures are performed by the actual member seeking cancellation. Cancellation is effective upon completion of the prescribed cancellation procedures.

Article 5 (Loss of Membership Qualification and Compensation Obligations)

1. The company reserves the right to revoke membership qualification if members provide false information when applying for membership qualification, or if members neglect their online shopping payment obligations, as well as in other situations recognized by the company as improper for its membership.

2. Members who perform any of the actions described below are responsible for compensating damages incurred by the company as a result of said action(s).
(1) Illicit use of member numbers or passwords
(2) Interfering with the business of the company, such as altering information on the home page, or sending harmful computer programs to the home page
(3) Actions that infringe on the intellectual property rights of products the company deals in
(4) Other actions in violation of the terms of use

Article 6 (Handling of Member Information)
1. As a general rule, the company will not disclose member information to third parties without the member’s prior consent. However, in any of the following situations, the company reserves the right to disclose member information and other customer information without prior consent.
(1) Disclosure is requested based on laws and ordinances
(2) Disclosure is deemed necessary by the company in order to protect its rights, interests, reputation, and the like

2. The company manages member information according to its “endeavors to protect personal information.” The company reserves the right to use member information in providing services to members, improving the contents of services, promoting the usage of services, and in efforts to ensure the soundness and smooth operation of services.

3. The company reserves the right to provide information (including advertisements) to members via e-mail newsletter and other methods. The company will stop providing such information to members who prefer not to receive it, given those members notify the company of their preferences in accordance with the methods prescribed by the company. However, the company cannot stop providing information essential to the operation of the service based on member preferences.

Article 7 (Prohibited Actions)

Members are prohibited from performing any of the following actions while using the service.

1. Actions in violation of laws and ordinances, the service terms of use, warnings for using the service, warnings for shopping with the service, or other regulations
2. Actions harmful to the rights, interests, reputation, etc. of the company and third parties
3. Actions which may negatively affect the mind or body of minors, or are otherwise in violation of public order and morality
4. Actions which bother other users or third parties, or cause them discomfort
5. Entering false information
6. Sending or posting harmful computer programs, e-mails, etc.
7. Unauthorized access of the company’s servers or computers
8. Leasing or transferring of passwords to a third party, or sharing of passwords with a third party
9. Other actions deemed inappropriate by the company

Article 8 (Service Suspension)

1. To maintain favorable operating conditions for the service, the company may entirely or partially suspend provision of the service—without prior notice—in any of the following situations.
(1) Regular or emergency system maintenance necessitates suspension
(2) The system is congested
(3) Fire, power outage, third-party interference, or other factors render system operation difficult
(4) Situations which necessitate system suspension, based on the company’s judgment

Article 9 (Modification/Discontinuation of Service)

The company reserves the right to discontinue/make appropriate modifications to all or a portion of the service, based on its own judgment and without prior notice.

Article 10 (Disclaimer)

1. The company assumes no responsibility for system suspension/termination/delay and disappearance of system data caused by faulty telecommunication circuits, computers, etc.; damages caused by unauthorized access to data; or other member-incurred damages related to company services.
2. The company makes no guarantees that e-mails sent from its web page, servers, domain, etc. are free of computer viruses and other harmful content.
3. The company assumes no responsibility for damages caused by member violations of the terms of use, etc.

Article 11 (Revisions to the Terms of Use)

The company reserves the right to revise the terms of use at its own discretion. Furthermore, the company may establish terms supplementary to the terms of use (hereinafter, “supplementary terms”). Revisions to the terms of use and the supplementary terms will take effect upon being posted to the website prescribed by the company. Members will follow these revised terms of use and supplementary terms.

Article 12 (Applicable Laws and Jurisdiction)

For disputes arising over the terms of use, the district court with jurisdiction over the company’s headquarters will serve as the court with exclusive jurisdiction over the first trial.
